BODOG 12 DAYS PROMOTION TOURNAMENT SERIES OFFICIAL RULES
AG Marketing Solutions Ltd. ("Sponsor") is offering the Bodog 12 Days Promotion Tournament Series (“Promotion”).
Open to all Players. Void where prohibited. Void in Canada and Costa Rica.
PROMOTION PERIOD
• The Promotion will begin at 2 p.m. (EST) on December 21st 2008 and shall end at 8:00am (EST) on January 16th, 2009, unless earlier terminated by Sponsor (the “Promotion Period”).
ELIGIBILITY AND ENTRY
• The Promotion is open only to Bodoglife.com members, eighteen (18) years of age or older (or of such age as constitutes the ‘age of majority’ in participant’s jurisdiction if greater than 18) who hold a valid Bodog player account (including an accurate, functioning e-mail address) (“Account”).
• Entrants will participate in a series of qualifying tournaments. Based on a player’s finish in each tournament, an Entrant’s top twelve point results are calculated and logged in a ranked leader board. Places 5th to 100th on the Tournament Leader Board (TLB) at the end of the 45 qualifying tournaments will move on to the “12 Days – Semifinal” and the top eighteen from the “12 Days – Semifinal” will win their way to the “12 days – Grand Finale”. Furthermore, places 1st to 4th on the Tournament Leader Board (TLB) at the end of the 45 qualifying tournaments will move on to the “12 Days – Grand Finale”. Entrants that participated in 5 or more qualifying tournaments that did not qualify for the “12 Days – Grand Finale”, will be entered into a random draw, and 5 players from that random draw will also be invite to participate in the “12 Days – Grand Finale”. There will be different types of qualifying tournament with buy-ins ranging from $10 to $162 and various structures.
• Employees, officers and directors of Sponsor, its respective affiliates, subsidiaries, parent companies, representatives, agents, promotion and other vendor agencies involved in this Promotion, and their immediate family members (spouse, parents, children, siblings, regardless of where they live) and individuals residing in the same household (whether or not related) of those employees, officers and directors are not eligible to participate.
• By participating, Participants agree to these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to the Promotion.
PRIZES
The following prizes are to be awarded to the winners of the “12 Days – Grand Finale” tournament to be hosted on January, 15th 2009 at 9:05pm ET.
• GRAND PRIZE. Three (3) Bodog Poker Open 3 Prize Package, including:
• Enough Tournament Credits on your Bodoglife.com Poker account in order to buy-into all championship and bounty events during the Bodog Poker Open 3 to be hosted in 2009. Bodog Poker Open 3 Qualifying tournaments do not qualify as a championship or bounty events.
• These prize packages will be awarded to the top 3 finishers of the “12 Days – Grand Finale” tournament.
The approximate retail value of the Grand Prize is $2,500 per winner. Actual value of prize may vary based on the buy-ins and dependant on the Bodog Poker Open 3 schedule. Prize to be awarded in Tournament Credits and credited to the winner(s)’s poker account at bodoglife.com. If winner(s) does (do) not accept prize as given, he/she/they shall forfeit the prize in its entirety and an alternate winner may be selected.
• FOURTH TO NINTH PLACES. Five (5) prizes will be awarded to the fourth- through ninth-place finishers of the “12 Days – Grand Finale” tournament, of $270 in tournament credits to be credited to each winner’s player account at poker.bodoglife.com to play in a Players Choice Semifinal.
WINNERS
• Potential winners’ eligibility shall be verified by Sponsor prior to the declaration of a winner’s status. Potential prize winners may be required to complete, sign, and return an affidavit of eligibility, mutually acceptable liability release, and publicity release within seven (7) calendar days after notice is sent, or the prize will be forfeited in its entirety and an alternate winner will be selected, time permitting.
• Winners will be contacted within forty-eight (48) hours by either telephone or email by a customer service representative of Sponsor or Sponsor’s designee.
• Except where prohibited, acceptance of a prize constitutes winner’s consent that his/her name, likeness, voice, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.
GENERAL CONDITIONS: Participants agree (a) that Sponsor, its parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively, the “Releasees”) are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize, or participation in this Promotion, or any Promotion- or prize-related activities and (b) winners grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the perpetual, worldwide right to the use of his/her name, picture, likeness, voice, video, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval and without additional compensation, unless prohibited by law. Winners may be required to be photographed with representative(s) of Bodog and provide Bodog with a quote containing their true thoughts about Bodog and the Promotion. Any such meeting with Bodog representative(s) for the stated purposes will be arranged with the winner(s) by Bodog at a mutually convenient time and place, and the reasonable cost (as solely determined by Bodog) of a winner's attending the meeting will be borne by Bodog. This quote and/or photo may be used (but Bodog will be under no obligation to do so) on the above and/or Bodog web sites and/or in newsletters and/or press releases (or as otherwise solely determined by Sponsor) concerning the Promotion. Participant shall indemnify, defend and hold harmless the Releasees from and against any and all claims, suits, proceedings, damages, costs, liabilities and expenses arising from or related to the Participant’s participation in the Promotion or acceptance or use of Prizes. Any Prizes that are eCash shall be deposited directly into the winning Participants’ Account. Technical or other requirements may require that the Prize deposits are made by means of more multiple deposits of smaller amounts. If a withdrawal is made before the prize terms are met, all bonus funds in addition to any money earned by wagering the Prize will be forfeited. Value of all prizes to be awarded is approximately $8,850.00. Winners are responsible for all applicable taxes and fees. Prize consists only of items specifically listed as part of the prize. Certain conditions and restrictions apply. Prizes are nontransferable and no substitution or cash equivalent is allowed, except as Sponsor may elect to permit in its sole discretion. Sponsor reserves the right to substitute prize of the same approximate retail value.
Disclaimer Of Warranties: Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize, or portion of any prize, furnished in connection with the Promotion. If a winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize will be forfeited and an alternate winner selected in a manner determined in Sponsor’s sole discretion, time permitting. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Promotion or in the announcement of prizes. Only the stated prizes will be awarded. Sponsor shall have the right to terminate or amend the Promotion or the Promotion rules at any time in its sole discretion. Without restricting the generality of the foregoing, in the event Sponsor is prevented from continuing with this Promotion, or the integrity and/or feasibility of the Promotion is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or any cause not reasonably within Sponsor’s control, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Promotion without further obligation and, if so, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received. If for any reason the Promotion, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Promotion, Sponsor reserves the right at its sole discretion to disqualify any individual Participant or its designated agents deemed responsible and Sponsor further reserves the right to cancel, terminate, modify or suspend the Promotion, with appropriate alternate method of prize award selected. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
